In December 2003, Friends of the earth were kicking up a stink about Asda, the massive UK grocery store chain because it was exploiting the UK planning system by building mezzanine floors in existing stores in order to avoid the need for a planning application. Apparantly the Internal works did not come within the definition of development so did not go through the planning permission process.

I'm not too sure why Friends Of The Earth are concerned, so I tried to look why mezzanine flooring levels could be a danger to our planet. The only logical thing that I could see was that the increased levels enable more storage facilities, this in turn provide more items to sell which may increase the number of customers, adding more cars and creating polution. Surely these extra customers at Asda-Walmart were shopping somewhere else...using the same cars?

If that is the case and I'm not saying it is - but I can't find any other reason, then if the mezzanine floors didn't exist, the storage space would be greatly reduced, so more deliveries would be needed ... by using those great big gas-guzzling cargo laden trucks that surely cause pollution. Anyway, what is stopping any warehouse, depot or superstore from using pallet racking ?.

The heavy-duty racking for palletised industrial storage requirements that range from single bays to fully integrated automated warehouse installations with both drive-in and walk in faciities.

Perhaps mezzanine levels have better pedestrian access - like any average second floor ?.

Anyway, the Government argued against the amendment to planning rules on the basis that local authorities have the ability attach conditions to planning permissions to limit floorspace. There was a case [Planning Inspectorate, Appeal Decision, Asda store, Ventura Park Road, Bitterscote, Tamworth, APP/Z3445/X/03/1117182]. where the local authority exercised their rights to attach conditions upon Asda's mezzaine floor, but Asda won their appeal.

It isn't just Asda, I need to add, other retailers including Homebase, Tesco, Next, Sainsbury's and Marks and Spencer are exploiting this 'loophole' to expand their premises. In many cases these stores are utilising such extensions to expand into other areas that are in direct competition with high streets stores, making there store not just a food outlet but a one stop store for clothing, shoes, medicines. furnishings etc.

A planning bill is being considered by the House of Lords after an amendment introduced by Lady Maddock, this would empower local councils to control the internal expansion of retail space. This means that any internal expansion that may increase the overall retail sales floor by more than 10% would require planning permission. Whilst the Planning and Compulsory Purchase Act 2004 received Royal Assent on 13 May 2004 this article was written in June 2004 and is accurate to date. The Lords' amendment, which is now enacted in s49, gives the Secretary of State power to specify circumstances where internal alterations which increase gross floor space by a given percentage, possibly 10% but to be specified by the Secretary of State, shall require planning permission. Any operation begun before the development order comes into effect, however, will not be affected. I can already hear the buzz at the offices of mezzanine floor suppliers in the UK such as T2 Storage.
